Public Offer Contract for the Provision of Information and Consulting Services by WomaNew.com
1. General Provisions
1.1. WomaNew.com (Self-Employed Entrepreneur A.M. Paliachok / “IP Paliachok A.M.”) hereinafter referred to as the Seller, publishes a Public Offer for the Provision of Information and Consulting Services, namely providing access to digital materials (patterns, master classes, lessons, and templates) presented on the Seller’s Website https://womanew.com .
1.2. In accordance with Article 464 of the Civil Code of the Republic of Belarus, this document is a public offer; therefore, if an individual accepts the terms and conditions set out below, the individual carrying out Acceptance of this Offer shall pay for access to the Seller’s digital materials in accordance with the terms and conditions of the Contract. In accordance with the Civil Code of the Republic of Belarus, payment for access to digital materials by the Buyer shall constitute Acceptance of the Offer, which is considered equivalent to entering into the Contract under the terms and conditions set forth in the Offer.
1.3. Based on the foregoing, please, read the text of the Public Offer carefully; if you do not agree with any clause of the Offer, you are advised to refuse to purchase or use the Services provided by the Seller.
1.4. Unless the context requires otherwise, the following terms shall have the following meanings in this Offer:
The Offer means a public offer of the Seller addressed to any individual/citizen to enter into a contract of sale (hereinafter referred to as the Contract) under the current terms and conditions set forth in the Contract, including all annexes to the Contract.
The Buyer means an individual who has entered into a Contract with the Seller under the terms and conditions set forth in the Contract.
Acceptance means full and unconditional Acceptance by the Buyer of the terms and conditions of the Contract.
The Digital Materials mean the item list presented on the official Website.
The Website means an Internet site owned by the Seller and hosted on the Internet at https://womanew.com, including all its sections, pages, file structure and any other structural elements, content, digital materials, source code and object code, designs, charts, audio works, video visual works, and photographs.
The Order means individual items from the range of Digital Materials specified by the Buyer when placing an application on the Website.
2. Scope of Contract
2.1. The Seller shall sell access to the Digital Materials in accordance with the current price list published on the Seller’s Website https://womanew.com, while the Buyer shall make payment and accept the Digital Materials in accordance with the terms and conditions of the Contract.
2.2. The Contract and annexes to the Contract are official documents of the Seller and shall be integral part of the Offer.
3. Checkout
3.1. Ordering access to the Digital Materials shall be carried out by the Buyer through the Internet site https://womanew.com .
3.2. The Buyer shall undertake to provide the following registration information about the Buyer when registering on the Seller’s Website: name, e-mail address; or only e-mail address when placing an Order without registration.
3.3. The Buyer shall have the right to edit the registration information about the Buyer. The Seller shall not have the right to change or edit the registration information about the Buyer without the consent of the latter. The Seller shall undertake not to disclose the Buyer’s data specified during registration on https://womanew.com and when placing an Order to persons not related to the execution of the Order. Having approved the Order of the selected Digital Materials, the Buyer shall provide the Seller with the necessary information in accordance with the procedure specified in clause 3.2 of the Contract.
3.4. The Seller shall not be responsible for the content and accuracy of the information provided by the Buyer when placing an Order.
3.5. The Buyer shall be responsible for the accuracy of the information provided when placing an Order.
3.6. Payment by the Buyer of the Order placed by the Buyer on the Website shall mean the Buyer’s consent to the terms and conditions of the Contract. The day of payment for the Order shall be the date of entering into the Contract of Sale between the Seller and the Buyer.
3.7. Should the Buyer have any questions regarding the properties or characteristics of the Digital Materials, the Buyer should consult the Seller before placing an Order.
4. Terms of Execution of the Order
4.1. The Digital Materials shall be delivered to the Buyer immediately after placing and paying for the Order. Delivery of Digital Materials may be delayed for up to 24 hours from the date of payment.
4.2. Should the Buyer provide false information about the Buyer’s contact details, the Seller shall not be responsible for the improper execution of the Order.
5. Payment for the Order
5.1. Payment for the Order shall be carried out by the Buyer by transferring funds to the Seller through the payment form posted on https://womanew.com. An information letter that is sent to the Buyer by e-mail after paying for the Order shall constitute confirmation of payment for the completed Order. The information letter shall contain a link(s) to download the Digital Materials.
5.2. Prices for any items of the Digital Materials specified on https://womanew.com may be changed by the Seller unilaterally without notice to the Buyer. Should the price of the ordered items of the Digital Materials change, the Seller shall undertake to inform the Buyer of such a change as soon as possible. The Buyer shall be entitled to either confirm or cancel the Order.
6. Delivery of Products
6.1. The Digital Materials shall be delivered to the Buyer by sending them to the specified e-mail address after placing and paying for the Order.
7. Order Return/Refund
7.1. Products reproduced on technical media shall not be subject to return or exchange for similar products.
7.2 The cost of the Services shall not be refundable (either in full or partially) to the Buyer, unless the services are not provided due to the Seller’s fault.
8. Copyright
8.1. All materials posted on https://womanew.com, as well as in the content of the Digital Materials, shall be the Seller’s property.
8.2. The Buyer shall have no right to copy the Seller’s materials, which are broadcast online, in whole or in part, record the broadcasts, or record the content of such Events in whole or in part in any way and/or on any physical medium, or use the content of such Events without written consent of the Seller, which shall be considered a violation of the exclusive right of the Seller and shall entail civil, administrative, and other liability in accordance with the current laws of the Republic of Belarus.
8.3. Distribution (free-of-charge or for a fee), printing, reproduction, processing, modification, or performance of any other actions with the Information Materials or information obtained in the course of the provision of services shall be prohibited.
9. Rights, Duties, and Responsibilities
9.1. The Seller shall not be responsible for the improper use of materials ordered on the Website by the Buyer.
9.2. All information received by the Seller from the Buyer shall be used solely for the purpose of providing the Services to the Buyer, as well as entering into and executing the Contract.
The Buyer hereby gives consent to the Seller to process the Buyer’s personal data, as well as any other information provided to the Seller, both with the use of automation tools and without the use of such tools, for the purposes specified in clause 9.2 of the Contract, as well as for the purposes of marketing research and promotion of the Seller’s products, from the date of this consent until the date five (5) years from the date of termination of the obligations of the Parties under the Contract, with the possibility of revoking such consent based on a written application by the Buyer.
The Buyer hereby grants consent to the Seller to send the Buyer periodic notices, messages, newsletters, and other informational and promotional materials to the e-mail address, telephone number, or using other contact information and communication tools provided by the Buyer to the Seller.
9.3. In case of non-fulfillment or improper fulfillment of obligations under the Contract, the Seller shall be liable for real (direct) losses incurred by the Buyer. However, the Seller’s liability shall be limited to the amount received by the Seller in payment for the Services.
9.4. The Buyer shall have the right to send all claims for improper execution of the Order to the e-mail address ( admin@womanew.com ) specified on https://womanew.com in the Contacts section. All information received shall be processed as soon as possible.
